TOWN OF HILES WILDLIFE ORDINANCE The Town Board of the Town of Hiles, Forest County, Wisconsin, do
ordain as follows: Section I: Public Nuisance Declared The Town Board of the Town of Hiles finds as a fact, after public
hearing, the presence of wildlife decoys is inconsistent with the natural
scenery and beauty of the roadside environment. All wildlife decoys in
plain view from town roads are a distraction to motorists to the extent of
absorbing their attention while driving and therefore a potential
contributing factor to unsafe driving and accidents. The Town Board
further finds this distraction caused by wildlife decoys represents a
serious potential danger to the health and safety of motorists and other
users of town roads of the Town of Hiles. The Town Board of Hiles in the
interest of ;public safety does hereby declare all wildlife decoys within
plain view from town roads of the Town of Hiles to be a public nuisance. Section II: Nuisances Prohibited No person, firm or corporation shall place or cause to be placed within
plain view from any town road in the Town of Hiles a wildlife decoy
without having first obtained a permit from the Town Board of Hiles under
this ordinance. Section III: Fees There is no application fee or permit fee for a permit under this
ordinance. A separate permit is required for each wildlife decoy. Section IV: Application for Permit Application for a permit to place a wildlife decoy within plain view
from a town road in the Town of Hiles shall be made in writing to the Town
Board. The application shall state: (a) The name and address of the applicant. (b) The legal description of the location of the proposed wildlife decoy and written authorization of the property owner. (c) The length of time the applicant intends on placing the wildlife decoy. (d) A description of the wildlife decoy. Section V: Granting of Permit All applications for permits will be considered by the Town Board at
its regularly scheduled meetings. Permits shall be granted or denied only
by the Town Board. Section VI: Revocation of Permit The Town Board may revoke any permit issued hereunder for cause upon
thirty (30) days notice to the applicant and an opportunity to be heard at
a regular Town Board meeting. Section VII: Severability and Conflict If any section, subsection, paragraph, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion of this
ordinance. Section VIII: Effective Date This Ordinance shall be in full force and effect from and after its
passage, approval, and publication, as required by law. Passed by the Town Board of the Town of Hiles, Wisconsin, this 8th
